“GLOBEX WORLDWIDE COURIER INC.” herein after “Globex” provides carriage of documents and parcels for clients herein after the “shipper” through an international network in which Globex is a participant.  The carriage is governed by the present contract.

I. General Conditions

1.If no service level is chosen on a manual Globex waybill, we will forward shipments sent within Canada and to the United States as a ‘’Next Day’’ service level. As for International destinations, the ‘’Express’’ service level will be applied.

2.When remitting his shipment for carriage, the shipper acknowledges that the present non negotiable air waybill was completed by himself or in his name and at his own risk by Globex acting only as agent without any liability on the part of Globex.  The shipper certifies that all the information supplied is correct and has been validated.

3.The goods described in the present contract are accepted for carriage in apparent good condition unless specifically indicated on the air waybill by Globex.

4.Globex does not accept in the present contract, passports, jewelry, tobacco, alcohol, travelers cheques, cash, as well as certain dangerous goods.

5.In order to speed up carriage, Globex may substitute another carrier including a land carrier without affecting the nature and conditions of this contract.

6.The shipper must provide all pertinent information on the contents and value of the shipment, which will be necessary for any customs authority or other authorities and will be responsible for any damage resulting from false, erroneous or contradictory statements.

7.All duties and taxes regarding shipments will be charged to the consignee, unless prior notice is given to Globex.

II. Limitation of Liability

7.If the carriage involves an ultimate destination or a stop in a country other than the country of departure, the liability of Globex may be submitted to the Warsaw Convention which governs and in most cases limits the liability of the carrier for loss, damage or delay to the goods unless a declared value (insurance) has been written on the contract before departure, in which case an additional amount can be charged to the shipper.  In no circumstances will the liability of Globex exceed the liability of the actual carrier.

8.The liability of Globex in case of damage or loss of a shipment will be limited to the maximum amount of $100 CDN per shipment.  This limit will be applicable even in the case of fault or negligence on the part of Globex.

9.In case of delay in delivery of the shipment, the liability of Globex is limited to the refund of the freight charged for the shipment.

10.In case of delay resulting in customs procedures or any other cause beyond the control of Globex, Globex will be exonerated from any liability.

11.In any event, Globex will not be liable for fortuitous, incidental damages, direct or indirect to the shipment.

III. Claims

12.In case of damages, partial loss, delay, non delivery or other claim, the shipper must send a written claim to Globex within thirty (30) days of the pick-up date by Globex.

13.No claim resulting from damage, loss or delay will be dealt with before the amount due for carriage has been paid.  The amount stated in the claim cannot be deducted from the freight due.

14.Any litigation between the Parties will be submitted to the law of the Province of Quebec and the Parties of this contract acknowledge the exclusive jurisdiction of the Courts of the City and District of Montreal, Province of Quebec.

Globex reserves the right to inspect all merchandise placed in its care.
